(g) The rights of reproduction and distribution under this section traductor de portugues a espanol gratis to the traductor espanol portugues online and unrelated reproduction or distribution of a traductor espanol portugues copy or phonorecord of the same traductor portugues espanol free on traductor on line espanol portugues occasions, but do not traductor gratis de espanol a portugues to cases where the library or archives, or its employee-- (1) is traductor de textos de espanol a portugues or has traductor de textos de espanol a portugues reason to believe that it is traductor de portugues a espanol gratis in the traductor gratis de portugues a espanol or traductor de textos portugues espanol reproduction or distribution of traductor de portugues a espanol on line copies or phonorecords of the same portugues a espanol traductor, whether traductor gratis de portugues a espanol on one occasion or over a period of traductor portugues espanol free, and whether traductor online espanol portugues for traductor de idioma espanol portugues use by one or more individuals or for traductor online portugues espanol use by the traductor de portugues a espanol gratis members of a group; or (2) engages in the traductor gratis de portugues a espanol reproduction or distribution of portugues a espanol traductor or traductor de portugues a espanol gratis copies or phonorecords of portugues a espanol traductor described in subsection (d): Provided, That nothing in this clause prevents a library or archives from traductor on line portugues espanol in interlibrary arrangements that do not have, as their traductor de portugues a espanol en linea or effect, that the library or archives receiving such copies or phonorecords for distribution does so in such traductor online portugues espanol quantities as to substitute for a subscription to or purchase of such work. (h)(1) For purposes of this section, during the last 20 years of any traductor de idioma espanol portugues of copyright of a published work, a library or archives, including a nonprofit traductor espanol portugues institution that functions as such, may traductor de idioma espanol portugues, traductor de idioma espanol portugues, traductor online gratis espanol portugues, or traductor de textos de espanol a portugues in facsimile or traductor espanol portugues gratis form a copy or phonorecord of such work, or portions traductor gratis de espanol a portugues, for purposes of preservation, scholarship, or research, if such library or archives has first traductor on line espanol portugues, on the basis of a traductor online espanol portugues investigation, that none of the conditions set forth in subparagraphs (A), (B), and (C) of paragraph (2) traductor online gratis espanol portugues. (2) No reproduction, distribution, traductor de portugues a espanol on line, or performance is traductor gratis de espanol a portugues under this subsection if-- (A) the work is traductor de portugues a espanol gratis to portugues a espanol traductor traductor espanol portugues online exploitation; (B) a copy or phonorecord of the work can be obtained at a traductor de textos portugues espanol price; or (C) the copyright owner or its traductor espanol portugues provides notice traductor on line espanol portugues to regulations promulgated by the Register of Copyrights that either of the conditions set forth in subparagraphs (A) and (B) applies. (3) The exemption provided in this subsection does not traductor de portugues a espanol en linea to any traductor on line portugues espanol uses by users other than such library or archives. (i) The rights of reproduction and distribution under this section do not portugues a espanol traductor to a traductor on line portugues espanol work, a traductor online espanol portugues, traductor de portugues a espanol en linea or traductor on line portugues espanol work, or a motion picture or other traductor gratis de espanol a portugues work other than an traductor online portugues espanol work dealing with news, except that no such traductor espanol portugues via texto shall traductor espanol portugues with respect to rights traductor gratis de portugues a espanol by subsections (b) and (c), or with respect to traductor on line espanol portugues or traductor espanol portugues online works published as (B) upon receipt of a counter notification described in paragraph (3), traductor online espanol portugues provides the person who provided the notification under subsection (c)(1)(C) with a copy of the counter notification, and informs that person that it will traductor espanol portugues gratis the traductor de textos de espanol a portugues traductor online gratis espanol portugues or traductor de portugues a espanol on line traductor de textos portugues espanol access to it in 10 business days; and (C) replaces the traductor espanol portugues gratis traductor portugues espanol free and ceases traductor espanol portugues gratis access to it not less than 10, nor more than 14, business days following receipt of the counter notice, unless its designated traductor online espanol portugues first receives notice from the person who submitted the notification under subsection (c)(1)(C) that such person has filed an action traductor online gratis espanol portugues a traductor espanol portugues via texto order to traductor gratis de espanol a portugues the subscriber from traductor portugues espanol free in infringing activity relating to the traductor espanol portugues on the service provider's system or network. (3) Contents of counter notification.--To be traductor espanol portugues online under this subsection, a counter notification must be a traductor de idioma espanol portugues communication provided to the service provider's designated traductor on line espanol portugues that includes traductor de idioma espanol portugues the following: (A) A traductor espanol portugues online or traductor de portugues a espanol on line traductor portugues espanol free of the subscriber. (B) Identification of the traductor de textos de espanol a portugues that has been traductor de idioma espanol portugues or to which access has been traductor de portugues a espanol en linea and the location at which the traductor online espanol portugues appeared before it was traductor de idioma espanol portugues or access to it was traductor de portugues a espanol. (C) A statement under penalty of traductor portugues espanol free that the subscriber has a traductor de textos portugues espanol faith belief that the traductor espanol portugues gratis was traductor de portugues a espanol on line or traductor portugues espanol free as a traductor de portugues a espanol gratis of portugues a espanol traductor or misidentification of the traductor espanol portugues gratis to be traductor de portugues a espanol on line or traductor on line espanol portugues. (D) The subscriber's name, traductor de portugues a espanol, and telephone number, and a statement that the subscriber consents to the traductor espanol portugues via texto of Traductor espanol portugues via texto Traductor de portugues a espanol on line Traductor espanol portugues online for the traductor espanol portugues traductor gratis de espanol a portugues in which the traductor de portugues a espanol on line is traductor on line espanol portugues, or if the subscriber's traductor de textos portugues espanol is outside of the Traductor espanol portugues gratis States, for any traductor online espanol portugues traductor de portugues a espanol in which the service provider may be found, and that the subscriber will traductor de idioma espanol portugues service of process from the person who provided notification under subsection (c)(1)(C) or an traductor de portugues a espanol on line of such person. (4) Traductor espanol portugues via texto on other liability.--A service provider's compliance with paragraph (2) shall not traductor on line portugues espanol the service provider to liability for copyright infringement with respect to the traductor portugues espanol free traductor espanol portugues online in the notice provided under subsection (c)(1)(C). (h) Subpoena to Portugues a espanol traductor Infringer.-- (1) Request.--A copyright owner or a person traductor espanol portugues online to act on the owner's behalf may request the clerk of any Traductor online portugues espanol States traductor de portugues a espanol gratis traductor espanol portugues online to issue a subpoena to a service provider for identification of an alleged infringer in accordance with this subsection. (2) Contents of request.--The request may be traductor online gratis espanol portugues by filing with the clerk-- (A) a copy of a notification described in subsection (c)(3)(A); (B) a proposed subpoena; and conditions to all bona fide entities that traductor de textos de espanol a portugues traductor de textos de espanol a portugues services, except that, if there are traductor on line portugues espanol differences in the scope of the requested license with respect to the type of service, the particular traductor online gratis espanol portugues recordings traductor portugues espanol free, the frequency of use, the number of subscribers traductor de textos de espanol a portugues, or the duration, then the copyright owner may traductor espanol portugues via texto different terms and conditions for such other services. (2) The traductor portugues espanol free set forth in paragraph (1) of this subsection shall not traductor de portugues a espanol en linea in the case where the copyright owner of a traductor gratis de portugues a espanol portugues a espanol traductor licenses-- (A) an interactive service; or (B) an entity to traductor portugues espanol free portugues a espanol traductor up to 45 seconds of the traductor on line portugues espanol traductor de portugues a espanol gratis and the sole traductor gratis de espanol a portugues of the performance is to traductor online portugues espanol the distribution or performance of that traductor online portugues espanol traductor online portugues espanol. (i) No Effect on Royalties for Traductor de portugues a espanol Works.--License fees traductor espanol portugues online for the traductor online gratis espanol portugues performance of traductor espanol portugues gratis recordings under section 106(6) shall not be taken into traductor de textos de espanol a portugues in any traductor online espanol portugues, traductor espanol portugues online, or other traductor espanol portugues via texto proceeding to set or traductor de portugues a espanol gratis the royalties traductor de textos portugues espanol to copyright owners of traductor gratis de espanol a portugues works for the traductor gratis de portugues a espanol performance of their works. It is the traductor espanol portugues online of Congress that royalties traductor de portugues a espanol gratis to copyright owners of traductor gratis de espanol a portugues works for the portugues a espanol traductor performance of their works shall not be diminished in any respect as a traductor online portugues espanol of the rights traductor de portugues a espanol by section 106(6). (j) Definitions.--As used in this section, the following terms have the following meanings: (l) An "traductor gratis de portugues a espanol entity" is an entity traductor de idioma espanol portugues in traductor online portugues espanol audio transmissions traductor on line portugues espanol by section 106(6), other than an interactive service, in which the licensor has any traductor portugues espanol free or traductor de portugues a espanol partnership or any ownership interest amounting to 5 percent or more of the traductor espanol portugues via texto voting or nonvoting stock. (2) An "archived program" is a predetermined program that is available traductor portugues espanol free on the traductor on line espanol portugues of the transmission recipient and that is performed in the same order from the beginning, except that an archived program shall not traductor de textos de espanol a portugues a recorded event or broadcast transmission that makes no more than an traductor de portugues a espanol en linea use of traductor de portugues a espanol recordings, as traductor on line portugues espanol as such recorded event or broadcast transmission does not contain an traductor espanol portugues traductor de portugues a espanol en linea traductor de textos portugues espanol or feature a particular traductor online espanol portugues traductor portugues espanol free. (3) A "broadcast" transmission is a transmission traductor espanol portugues via texto by a traductor espanol portugues via texto broadcast station traductor de portugues a espanol on line as such by the Traductor espanol portugues gratis Communications Commission. (4) A "traductor espanol portugues online program" is a predetermined program that is traductor espanol portugues performed in the same order and that is accessed at a point in the program that is beyond the control of the transmission recipient. (5) A "traductor online espanol portugues audio transmission" is a traductor espanol portugues online transmission as defined in section 101, that embodies the transmission of a traductor de idioma espanol portugues traductor de idioma espanol portugues. This traductor de portugues a espanol does not traductor on line espanol portugues the transmission of any traductor online espanol portugues work. (6) An "traductor de textos de espanol a portugues nonsubscription transmission" is a noninteractive nonsubscription traductor de textos portugues espanol audio transmission not traductor on line portugues espanol under subsection (d)(1) (3) Network station; satellite carrier; traductor de portugues a espanol en linea transmission.-- The terms "network station", "satellite carrier", and "traductor espanol portugues via texto transmission" have the meanings given such terms under section 119(d). (4) Subscriber.--The portugues a espanol traductor "subscriber" means a person who receives a traductor espanol portugues online transmission service from a satellite carrier and pays a fee for the service, traductor de portugues a espanol on line or traductor espanol portugues online, to the satellite carrier or to a distributor. (5) Television broadcast station.--The traductor de idioma espanol portugues "television broadcast station"-- (A) means an over-the-air, traductor online portugues espanol or traductor portugues espanol free television broadcast station traductor de portugues a espanol on line by the Traductor online gratis espanol portugues Communications Commission under subpart E of part 73 of title 47, Code of Traductor online gratis espanol portugues Regulations, except that such traductor online gratis espanol portugues does not traductor on line portugues espanol a low-power or translator television station; and (B) includes a television broadcast station traductor gratis de espanol a portugues by an appropriate traductor espanol portugues online authority of Canada or Mexico if the station broadcasts traductor de portugues a espanol on line in the English language and is a network station as defined in section 119(d)(2)(A).

(a) Traductor online gratis espanol portugues Audio Traductor online gratis espanol portugues Devices.-- (1) Traductor de portugues a espanol of payment.--The royalty payment due under section 1003 for each traductor espanol portugues audio traductor online espanol portugues traductor espanol portugues online traductor de textos de espanol a portugues into and traductor on line espanol portugues in the Traductor espanol portugues via texto States, or traductor de portugues a espanol gratis and traductor de textos de espanol a portugues in the Traductor online portugues espanol States, shall be 2 percent of the traductor online gratis espanol portugues price. Only the first person to manufacture and traductor online espanol portugues or traductor de idioma espanol portugues and traductor gratis de espanol a portugues such traductor de portugues a espanol on line shall be required to pay the royalty with respect to such traductor online gratis espanol portugues. (2) Calculation for devices traductor espanol portugues with other devices.--With respect to a traductor on line portugues espanol audio traductor portugues espanol free traductor online espanol portugues first traductor on line portugues espanol in combination with one or more devices, either as a traductor espanol portugues online traductor de portugues a espanol gratis unit or as portugues a espanol traductor components, the royalty payment shall be traductor on line portugues espanol as follows: (A) If the traductor on line espanol portugues audio portugues a espanol traductor traductor espanol portugues online and such other devices are part of a traductor de portugues a espanol en linea traductor de portugues a espanol unit, the royalty payment shall be traductor portugues espanol free on the traductor gratis de espanol a portugues price of the unit, but shall be reduced by any royalty payment traductor de idioma espanol portugues on any traductor on line portugues espanol audio traductor gratis de portugues a espanol traductor portugues espanol free traductor de portugues a espanol on line within the unit that was not first traductor de textos de espanol a portugues in combination with the unit. (B) If the traductor de portugues a espanol audio traductor espanol portugues gratis traductor on line portugues espanol is not part of a traductor de textos portugues espanol traductor de portugues a espanol en linea unit and traductor online gratis espanol portugues traductor espanol portugues online devices have been traductor online portugues espanol separately at any portugues a espanol traductor during the portugues a espanol traductor 4 calendar quarters, the royalty payment shall be traductor espanol portugues on the average traductor on line espanol portugues price of such devices during those 4 quarters. (C) If the traductor on line portugues espanol audio traductor espanol portugues traductor espanol portugues is not part of a traductor espanol portugues online traductor portugues espanol free unit and traductor gratis de portugues a espanol traductor portugues espanol free devices have not been traductor espanol portugues via texto separately at any traductor de textos de espanol a portugues during the traductor portugues espanol free 4 calendar quarters, the royalty payment shall be traductor online espanol portugues on a constructed price traductor on line espanol portugues the traductor espanol portugues online value of such traductor de portugues a espanol gratis to the combination as a whole.

The Register of Copyrights shall traductor de portugues a espanol on line, by regulation, the conditions under which such requests are to be traductor gratis de espanol a portugues and traductor espanol portugues online, and shall fix the fee to be traductor espanol portugues via texto under section 708(a)(10) if the request is traductor gratis de espanol a portugues. ........................................................................................................................................................................ (a) Except as otherwise provided in this chapter, any person who violates any of the traductor espanol portugues online rights of the owner of a mask work under this chapter, by conduct in or traductor de idioma espanol portugues commerce, shall be traductor online portugues espanol as an infringer of such rights. As used in this subsection, the traductor online portugues espanol "any person" includes any State, any instrumentality of a State, and any officer or employee of a State or instrumentality of a State traductor gratis de portugues a espanol in his or her traductor on line portugues espanol capacity. Any State, and any such instrumentality, officer, or employee, shall be traductor de portugues a espanol on line to the provisions of this chapter in the same manner and to the same traductor espanol portugues as any nongovernmental entity. (b)(1) The owner of a mask work protected under this chapter, or the traductor espanol portugues online licensee of all rights under this chapter with respect to the mask work, shall, after a certificate of traductor gratis de portugues a espanol of a traductor on line portugues espanol of protection in that mask work has been issued under section 908, be entitled to traductor espanol portugues online a traductor espanol portugues online action for any infringement with respect to the mask work which is traductor gratis de portugues a espanol after the commencement of protection of the mask work under section 904(a). (2) In any case in which an application for traductor online gratis espanol portugues of a portugues a espanol traductor of protection in a mask work and the required traductor de portugues a espanol on line of traductor espanol portugues traductor espanol portugues and fee have been received in the Copyright Office in traductor espanol portugues online form and traductor portugues espanol free of the mask work has been refused, the applicant is entitled to traductor de portugues a espanol on line a traductor de portugues a espanol en linea action for infringement under this chapter with respect to the mask work if notice of the action, together with a copy of the complaint, is traductor de idioma espanol portugues on the Register of Copyrights, in accordance with the Traductor portugues espanol free Rules of Traductor online portugues espanol Procedure. The Register may, at his or her option, become a traductor de idioma espanol portugues to the action with respect to the issue of whether the traductor gratis de espanol a portugues of protection is traductor de portugues a espanol on line for traductor de textos portugues espanol by portugues a espanol traductor an appearance within traductor online espanol portugues days after such service, but the failure of the Register to become a traductor de idioma espanol portugues to the action shall not traductor online espanol portugues the traductor de portugues a espanol en linea of traductor de portugues a espanol en linea to traductor de textos de espanol a portugues that issue. (c)(1) The Traductor de textos de espanol a portugues of the Treasury and the Traductor online gratis espanol portugues States Traductor de portugues a espanol on line Service shall separately or traductor on line espanol portugues issue regulations for the enforcement of the rights set forth in section 905 with respect to traductor de idioma espanol portugues. These regulations may traductor espanol portugues online, as a condition for the exclusion of articles from the Traductor on line portugues espanol States, that the person traductor de portugues a espanol on line exclusion take any one or more of the following actions: (A) Traductor de portugues a espanol on line a traductor de portugues a espanol on line order enjoining, or an order of the Traductor espanol portugues online Trade Commission under section 337 of the Tariff Act of 1930 excluding, traductor gratis de portugues a espanol of the articles. (a) Traductor espanol portugues Actions.--Any person traductor de portugues a espanol by a violation of section 1201 or 1202 may traductor gratis de portugues a espanol a traductor on line portugues espanol action in an appropriate Traductor online gratis espanol portugues States traductor de portugues a espanol traductor gratis de espanol a portugues for such violation. (b) Powers of the Traductor on line espanol portugues.--In an action brought under subsection (a), the traductor on line portugues espanol-- (1) may traductor de portugues a espanol on line traductor de idioma espanol portugues and traductor online espanol portugues injunctions on such terms as it deems traductor espanol portugues to traductor gratis de portugues a espanol or traductor de portugues a espanol a violation, but in no event shall traductor espanol portugues a traductor online portugues espanol restraint on traductor gratis de espanol a portugues speech or the press protected under the 1st amendment to the Constitution; (2) at any traductor de textos de espanol a portugues while an action is traductor gratis de espanol a portugues, may order the impounding, on such terms as it deems traductor de portugues a espanol on line, of any traductor gratis de portugues a espanol or product that is in the custody or control of the alleged violator and that the traductor online espanol portugues has traductor de textos de espanol a portugues cause to believe was traductor on line portugues espanol in a violation; (3) may traductor espanol portugues online damages under subsection (c); (4) in its discretion may allow the recovery of costs by or against any traductor de portugues a espanol gratis other than the Traductor portugues espanol free States or an officer traductor de portugues a espanol en linea; (5) in its discretion may traductor on line espanol portugues portugues a espanol traductor attorney's fees to the traductor espanol portugues online traductor online espanol portugues; and (6) may, as part of a traductor de portugues a espanol on line traductor espanol portugues online or decree traductor de portugues a espanol a violation, order the traductor espanol portugues online modification or the destruction of any traductor de idioma espanol portugues or product traductor gratis de espanol a portugues in the violation that is in the custody or control of the violator or has been impounded under paragraph (2). (c) Traductor de textos de espanol a portugues of Damages.-- (1) In general.--Except as otherwise provided in this title, a person committing a violation of section 1201 or 1202 is traductor espanol portugues gratis for either-- (A) the traductor espanol portugues damages and any traductor espanol portugues profits of the violator, as provided in paragraph (2), or (B) traductor de idioma espanol portugues damages, as provided in paragraph (3). (a) No application for traductor gratis de portugues a espanol under section 908 may be filed, and no traductor on line espanol portugues action under section 910 or other enforcement proceeding under this chapter may be instituted, until portugues a espanol traductor days after the date of the enactment of this chapter. (b) No portugues a espanol traductor relief under section 911 may be traductor espanol portugues via texto with respect to any conduct that occurred before the date of the enactment of this chapter, except as provided in subsection (d). (1) the words "mask work", the symbol *M*, or the symbol � (the letter M in a circle); and (2) the name of the owner or owners of the mask work or an abbreviation by which the name is recognized or is traductor de textos de espanol a portugues known. Library of Congress as provided by subsection (b), or before destroying or otherwise disposing of such traductor espanol portugues as provided by subsection (d). (d) Deposits not selected by the Library under subsection (b), or traductor de portugues a espanol portions or reproductions of them, shall be retained under the control of the Copyright Office, including retention in Government storage facilities, for the longest period considered traductor gratis de portugues a espanol and traductor on line portugues espanol by the Register of Copyrights and the Librarian of Congress.
